The Palm Beach County School District did not vote to terminate a teacher who was accused of making a death threat.

That's because Raymond Berger, who taught physical education at Eagles Landing Middle School, stepped down a day before that vote was scheduled to take place.

The board planned to vote at Wednesday night's meeting on Berger's termination for saying in front of students that he was "going to (expletive) kill someone" and "rip" out someone's eyes. But records from the Palm Beach County School District show the 56-year old submitted his retirement effective Tuesday.

Complaints about the comments were made back in April at the school in suburban Boca Raton.

Superintendent Donald Fennoy had recommended Berger be fired.
